Can you have a loaded gun inside your home if you live with children?

Generally, you may possess a loaded firearm in your home, provided you are a law-abiding citizen and comply with local gun laws. However, the presence of children in your home introduces additional concerns and responsibilities.

“Safe storage” laws

Many states have enacted “safe storage” laws that typically require gun owners to store firearms in such a way that a child cannot gain access to them—for example, using a locked safe to store their guns.

If you know, or should know, that a child is likely to gain access to a firearm within a home, you must take reasonable steps to secure it. Failure to do so can result in harsh consequences, including criminal charges.

Safely storing your gun

To ensure you comply with “safe storage” laws and prevent children from accessing your gun, consider the following tips:

  • Purchase a quality, childproof gun safe or lockbox
  • If you have children at home, teach them in an age-appropriate way about gun safety, including the importance of never touching a firearm without adult supervision and permission.
  • Communicate regularly with your children about the importance of gun storage for safety purposes
  • Check your safe or lockbox regularly to ensure your gun is still there. Do not forget to lock it.

Unauthorized access

Wondering what happens if a child accesses your gun? If a child gains access to your firearm and causes an injury or death, you (the gun owner) may face criminal charges. This is especially true if it is determined that you did not take reasonable steps to secure it.

While it is generally legal to own a gun and have it in your home with you, Washington State cares about responsible ownership and safe storage practices to protect children and prevent accidents. If you have specific questions, contact your criminal defense attorney today.
